APPLE APP STORE CLASS ACTION

Overview

This Scheme relates to a class action (the Class Action) against Apple Inc and Apple Pty Limited (collectively, Apple). The Class Action relates to allegations of anti-competitive conduct by Apple in relation to the operation of its Apple App Store and its charging of commissions for certain app purchases and/or certain in-app purchases from 6 November 2017 to 20 June 2022 (Relevant Period).

Australian consumers who made certain app purchases from the Apple App Store and/or certain in- app purchases from apps downloaded from the Apple App Store within the Relevant Period may be entitled to compensation for losses under ss 82 and 87 of the Competition and Consumer Act 2010 (Cth) (Act) caused by contraventions of ss 45, 46 and 47 of the Act.

The precise composition of the Defendant Entities, which may change from time-to-time, is determined by the Representative Member in consultation with the Lawyer and the Funder.

The Class Action is being funded and conducted as a litigation funding scheme, compliant with regulations introduced by the Australian Government in 2020. The name of the scheme is the Apple Litigation Funding Scheme (ARSN 655 066 934) (the Scheme).

As the Scheme's Responsible Entity, CASL Governance Ltd (CASL) is responsible for issuing the Scheme's Product Disclosure Statement, as well as any interests in the Scheme.

Am I a potential Class Member?

If you made certain app purchases from the Apple App Store and/or certain in-app purchases from apps downloaded from the Apple App Store during the Relevant Period as defined above, you may be a Class Member.

What action do I need to take?

Eligible purchasers are automatically included as group members in the claim, and no registration or application to join the Scheme is required at this stage.
